Contract for Services

Cost and Settlement
The charges for Garden Gems Landscaping services will be established according to the project scope and confirmed in writing before work begins. Any extra expenses arising from scope modifications or unexpected factors will be shared with the client and approved before execution.
Plan for the Project
The anticipated timeline for landscaping projects will be outlined in the service agreement with the client. While Garden Gems Landscaping intends to meet these deadlines, factors such as weather, delivery delays, or unforeseen site issues may influence project duration. The Company will communicate any necessary changes to the client promptly. The Company will keep clients updated on any timeline changes without delay.
Obligations of the Client
The client shall provide Garden Gems Landscaping with site access whenever necessary throughout the project timeline. The client is also responsible for arranging any required permits or authorizations for the landscaping services. The client must clearly mark any underground utilities, irrigation setups, or infrastructure on the property to reduce the risk of accidental damage during work or underground structures to ensure they are not disturbed during the construction process.
Assurance and Guarantee.
Garden Gems Landscaping guarantees the quality of its craftsmanship and materials in landscaping projects. The Company provides a warranty on installed plants and materials for a defined timeframe, as specified in the service agreement. Problems or concerns about the landscaping work should be communicated to Garden Gems Landscaping immediately, and the Company will implement suitable actions to resolve and correct the issue within an acceptable period.
Obligation and Restitution.
Although Garden Gems Landscaping implements every necessary safeguard for the safety and quality of its work, the Company won't be responsible for damages, injuries, or losses due to nature, vandalism, neglect, or misuse of landscaping elements by the client or others. The client consents to indemnify and hold Garden Gems Landscaping free from claims, liabilities, or expenses associated with the landscaping services delivered.
Services Discontinuation
Any party can end the landscaping services by giving written notice to the other in line with service agreement terms. Should it be terminated, the client consents to pay Garden Gems Landscaping for all work performed up till termination, along with any relevant cancellation fees or costs borne by the Company.
Applicable Law
The conditions and terms shall be governed by the jurisdiction laws where Garden Gems Landscaping operates and construed accordingly. All disputes related to or arising out of landscaping services provided will be settled through amicable negotiations among the parties involved. Should no resolution be found, the parties consent to submit to the exclusive jurisdiction of the relevant jurisdiction's courts.
Adjustments and Changes
Garden Gems Landscaping holds the right to change or update these terms and conditions at any time without advance notice. Any changes will be issued to the client in writing and shall govern all future transactions with the Company will apply to subsequent dealings with the Company.
By employing Garden Gems Landscaping services, the client accepts that they have read, understood, and agree to comply with the terms and conditions outlined herein.
